Some Research On Legitimate Issues Of Prevention And Cure Of Desertification In Western Regions Of China

Desertification is one of the main environmental problems in the world. It is also the most prevalent ecological problem in China and for a long time it impedes the ecological environment protection and construction as well as the social development. It also threatens the sustainable development of the desertification areas. Desertification not only leads to the deterioration of ecological environment, affecting the living condition of people, but also causes the drop production of agriculture and animal husbandry, intensifying the clash between people and the land. Increasing the poverty of ecological fragile region, hampering the development of economy. Minqin is situated between Alashan Zuoqi and Alashan Youqi and it is the only oasis hampering the integration of the third desert Badanjilin and the fourth desert Tengeli. It is the forefront area of desertification monitoring and combating, a bridgehead of sand line in the northwestern part of China. The central government as well as the scholars in and abroad have attached great attention to the threat of desertification of Minqin and the Prime Minister Wen Jiabao indicated for eleven times that the Chinese people will never make Minqin the second luobubo.The article starts from the present desertification condition of Minqin, analyzes the reason of its land desertification and indicates that human activities are the decisive reason of intensifying the desertification of this area. It discusses the legislative condition of prevention and cure of desertification, explores the existing problems of this issue in legitimate system and studies the issue from the following six perspectives: The first problem is the limitation of . Then the article indicates the lawful defect of resource management. Lastly, It analyzes that the source of funding in combating the desertification is unitary and it is not effective to protect the benefit of people involved in waging desertification. Some strategies on optimizing the prevention and cure of desertification in western area are proposed in connection with the previously mentioned problems, such as establishing the sustainable use carrying capacity criteria; constructing reasonable natural resource property right system; rationalizing administrative power and clarifying the administrative duty; developing sand industry considerably and setting up the encouragement and praise system of desertification prevention and cure, etc. In conclusion, the article points out that carrying out the legislative research on prevention and cure of desertification, optimizing legitimate system of the issue will be of great significance to the sustainable development of the society and economy; to the harmonious relationship between human beings and the nature.
