China is one of the countries most severely affected by desertification hazards, the area of desertification, wide distribution, the degree of weight. Desertification has seriously hampered the coordinated development of the desertified areas and even the country’s population, resources and environment. Desertification is caused by natural and man-made two major factors, and mainly due to human factors. This means that if people’s behavior to be regulated to make it comply with the laws of nature, is equivalent to eliminating the main cause of desertification, a fundamental solution to the problem of desertification. Law can control and arrangement of people and people between the mutual relations between man and nature, and thus the one hand, the regulation of human activities in the natural environment can withstand the range, on the other hand the system through the construction of rules to encourage human beings to actively cope with desertification, thus an anti-governance to achieve the purpose of combating desertification. However, China did not establish a relatively complete legal system to regulate, guide prevention practice. Therefore, to enhance the desertification prevention and control of legal studies and to intensify desertification control law formulation, reform, perfect is particularly important.This article is divided into four parts, the first part introduces the concept of desertification, step by step analysis of the status of desertification, causes of desertification hazards. The second part of the United States, Israel, Australia and other foreign countries on desertification prevention and control legislation, the United Nations Convention to Combat Desertification, the International Covenant on current laws related to desertification control, a simple introduction. The third part through the analysis of existing legal provisions that the problems of desertification prevention and control legal system, including:1. Part of the legal provisions governing the lag between the law provides that there is a conflict;2. The law is too abstract, and the lack of maneuverability; public participation, lack of ecological compensation mechanism, the natural ownership of the system is unreasonable; economic security mechanisms are inadequate. The fourth part for the problems that China put forward the idea of the perfect to Combat Desertification in China legal system, namely:(1) to strengthen the legislative work to ensure that laws and regulations unified, coordinated and effective. Specific legislative plan including the development of science as well as a comprehensive and systematic clean-up, adjust the existing laws. Enhanced legal operability. Including to improve the laws and regulations, strengthen the construction of local legislation and related laws and regulations, attention to the procedural legislation.(3) improve the reform of the relevant legal system. Including the establishment and improvement of the system of public participation, improve the ecological compensation mechanism, the reform of natural resource tenure system.(4) establish a greater diversity of desertification prevention and control funding mechanism. Including to improve the government’s financial investment regime has formulated preferential policies to attract social funds, including the strengthening of international cooperation, to encourage individual donors, and other measures including the issue of desertification prevention and control welfare lottery.
