The dissertation insists on methodology of documents,history and politicsand analyzes the relation of jurisdiction,the people'congresses supervision and the Party'leadership. Furthermore, it explores the national power balance between them adjusting to Chinese facts and constitution.The dissertation falls on five parts. Introduction argues the background and research results on the issue. Chapter 1 describes jurisdiction problems during the judicial reform and the constitutional regulations about it. Chapter 2 points out the violating phenomenon in the course of supervising and leading jurisdiction according to constitution. Chapter 3 analyzes the reasons of incoordination between jurisdiction,the people'congresses supervision and the Party'leadership. Chapter 4 discusses the resolution by promoting constitutional enforcement in order to respect and balance between them. Finally, the dissertation points out that there is complicated relations. It is necessary to create new systems according to constitution and develop constitutional regulation under the judicial practices. Otherwise, it is necessary to interpret constitution according to the development of judicial practices, and prevent political power interfering jurisdiction.
