Research On The Right To Decide Major Matters Of Local People’s Congresses Under The Leadership Of The Communist Party Of China

The system of people’s congresses is an important institutional carrier of the whole process of people’s democracy,and can effectively ensure that people’s democracy is embodied in the process of the Party’s governance.Local people’s congresses are empowered by the Constitution and laws to make the right to decide on major matters,and it is an important form for people in all regions to participate in democratic politics and express their demands.Exercising the right to decide on major matters by local people’s congresses in accordance with the law is an important way to practice the principle that all state power belongs to the people."We need to strengthen the Party’s overall leadership over the work of the National People’s Congress," xi said in his speech at the 2021 WORKING session of the CENTRAL People’s Congress.As one of the basic functions and powers of local people’s congresses,it is necessary for the Party to lead the local people’s congresses to exercise the right to decide major matters.However,through the analysis of the local laws and regulations discussed and decided by the national people’s congresses of all provinces and municipalities directly under the Central Government,as well as the reference to the work experience and academic theories of all places,there are still deficiencies in the local party committees leading the local people’s congresses to exercise the right to decide major issues.In terms of the normative basis,the regulations formed by local party committees are not perfect,the basis of interaction between local party committees and local people’s congresses is not perfect,and the legislative design of major issues decided by local people’s congresses is not scientific.In terms of actual implementation,the system of local party committees leading local people’s congresses to make decisions on major issues is insufficient,and the effectiveness of local people’s congresses to exercise their decision-making power is insufficient.In terms of theoretical research,the relationship between the party committee’s decision-making power and decision-making power of the local people’s congresses on major issues is not clear,and the relationship between Local people’s congresses make the right to decide major matters and other powers of local people’s congresses is not clear.Therefore,the work experience of local party committees leading local people’s congresses to exercise the right to decide major matters is summarized,the existing problems are analyzed,and the optimization path is explored to promote local party committees leading local people’s congresses to exercise the right to decide major matters as well as possible.For this purpose,on the basis of studying and referring to the existing research,this paper proposes the following optimization paths in view of the current problems: First,strengthen the system design,improve the responsibilities of local party committees and local people’s congresses in the process of deciding major issues.Second,we improved working mechanisms and strictly implemented the working mechanism for local party committees leading people’s congresses to make decisions on major issues and the system for people’s congresses to make decisions to improve the effectiveness of our work.Third,strengthen theoretical research,straighten the relationship between Local people’s congresses make the right to decide major matters and the the decision-making power of party committees,and straighten out the relationship between the other functions and powers of the local people’s congress and decision-making power of major issues.
