A Research On Public Participation In Local Legislation

This thesis makes probe into public participation in legislation, which is a topic of abundant practice and exhaustless theories.Local legislation as an indispensable part of the legislation system of china plays an important role in strengthening the national legislation system, Protecting the socialist democracy and ruling the country according to laws. Public participating in legislation plays an important role political civilization construction. The legalized scope and procedure of public participating in legislation mark the developing of our political civilization construction. From 1978 on , we have been making efforts to improve the quality of legislation, which also witnesses the gradually progress of our political civilization. It means a lot to the democratic procedure in local legislation.The thesis studies the practice and cases of public participation in Chinese legislation nowadays. It firstly discusses the legalized scope leading to the development of public participation in Chinese legislation and the methods used for public participation; then it analyzes the present problem and causes of public participation in Chinese legislation; finally it gives a brief description about viewpoints and issues that need to discuss and solve regarding public participation in local legislation in China. Obviously, the following measures can be taken for solutions, including strengthening citizen' s consciousness of legislative participation, improvement of techniques of participation, perfection of the system on public participation, establishment of effective interest expression mechanism and expansion of interest expression channels.The defect of current public participation in local legislation, based on the present legislative environment and limited by the present legislative skills, is suitable to the economic and social situation in today' s China. What we need to do is to realize the effective supervision and restriction of local legislation, and to ensure its operation legally and justly by consummating the systems and expanding the public participation.
