Only the civil liability was investigated after the food safety incidents by our Current law. So the victims were always difficult to obtain timely and adequate relief. This article analyzes the defects of liability investigating mechanism on food safety incidents in our state, demonstrates that government bears the responsibility of supervision of food safety incidents; In addition, it analyzes the Social significance and basis of jurisprudence for Government to take legal responsibility for food safety incidents, and the feasibility of the existing system's supporting. And then, advocates that if the food safety incidents can be attributed to government and its staff's omission, the state should take on the responsibility of Compensation. Meantime, the state liability is additional responsibility for security. After the state compensation, the victim is still entitled to bring a civil action, while the state has the right to recover the infringer.
