The Research On Accountability Of Public-rasing Foundation In China

Since 1978, charity work has been developed significantly in China, for example, when facing Sichuan earthquake and Hunan ice and snow damage, charity work have great contribution. The development of charity work in China is proofed by the attention from government and public, increasing number of volunteers. As the media of charity, foundation develops significantly as well since 1980s. More and more people are getting start to care its effects. However, as foundation is developing, the legal system is not developed, which leads many negative results such as inefficiency of the operation and disappointment of public. That make foundation going to encounter questionings of accountabiliy. Public-raising foundation is very special in fund community organizations. Compared with non-public-raising foundation, it effects widely. Therefore, this essay attempts to account public-raising foundation and build a public-raising foundation accountability system.According to rational economic man theory, principal-agent theory, property rights theory and stakeholder theory, the accountability system research of public-offering Foundations is feasible and necessary. The study requires the definition of the constituent elements of China's public-offering foundations. The five elements in this paper contain the main body of accountability, accountability object, the content of accountability, accountability procedures and the results of accountability. With the analysis of the status quo of China's public-offering foundations through the five elements, we can see the problems of the accountability system of China's public offering foundations, which are the main body vacancy of accountability, the object of accountability is not clear, the content of accountability is fuzzy, lack of accountability procedures, the effectiveness of the results of the accountability is not strong. In general, China's public offering foundations have not yet established a complete system of accountability. The causes of the problems are that the legal framework for accountability of public-offering foundations is not sound, the Foundation management system defects, the level of information disclosure is low, the lack of effective assessment, the self-discipline ability is not high and the lack of accountability culture.The accountability practice of Foundations abroad is earlier than that of China. therefore, the related systems and the environment abroad are more matured. The paper analyzes the accountability of foreign foundations, introduces the accountability models of Germany and the United States, combines with relevant experience of other countries, summarizes the accountability status of foreign foundations, and then analyzes six aspects worthy of learning, which are the legal framework for the accountability of foreign foundations, foundations management system, information disclosure system, evaluation system, foundations self-discipline capability and a culture of accountability.The improvement of the accountability system of China's public-offering Foundations are as follows:the overall design of the accountability system of China's public offering Foundations, including the active participation of the main body of accountability, the specification of the object of accountability, clear definition of the contents of accountability, operational effectiveness of accountability procedures and higher feasibility of accountability results; the improvement of laws and regulations of the accountability of public-offering foundations; the regulation of management system of public-offering foundations; the completion of the information disclosure system; the improvement of the assessment system; the enhanced self-discipline ability of public-offering Foundations; the creation of a culture of accountability of public-offering Foundations.
