Research Of Law Issues For The Old-Age Insurance Of Rural Migrant Workers

In recent years, much attention has been paid to improving the old-age insurance of rural migrant workers,which the central and local governments are also trying to solve.They have designed distinctive old-age insurance of migrant workers.However, because of law limited involvement and the complexity of the own problems of migrant workers,these policies have not achieved an ideal effect, the old-age insurance whether central or local governments designed are caught in crossfire, the phenomenon of migrant workers'low enrollment, high surrender rate and difficult transfer is appeared in various parts.So,it is very important to solve the problem of the old-age insurance of rural migrant workers which exploring from legal and system.In this paper, the old-age insurance of migrant workers is discussed by using the logical method of asking questions,analyzing and solving problems. First of all,points out the problems of the implementation of migrant workers' pension and analyze the causes,then combines with China's national conditions and references to the advanced experiences of foreign countries, through using the views of legal theory and the theory of dialectical materialism, proposes the legal advice of the perfecting of the old-age insurance for migrant workers.The article concludes three chapters totally:Chapter 1 raises the basic question of migrant workers'old-age insurance.By describing the characteristics of China's old-age insurance and the old-age insurance of migrant workers and combining with the characteristics of migrant workers, proposes the shortcomings of the old-age insurance for migrant workers in implementation.Chapter 2 analyzes some problems of the old-age insurance for migrant workers.First of all,analyzes the reasons that caught in crossfire in the implementation of the old-age insurance for migrant workers from the legal point of view. Secondly, by combining with the legal theory and principles of economic law, argues the legitimacy and feasibility of improving the old-age insurance of rural migrant workers; finally, analyzes and compares legal characteristics of the old-age insurance of our country's urban residents and similar groups abroad, to provide the advanced experiences for the old-age insurance of migrant workers.Chapter 3 proposes the legal advices during the establishment of the old-age insurance of migrant workers on the two parts before.First, clears the legal definition of migrant workers, to establish a legal basis for improving the old-age insurance of migrant workers;secondly, provides diversified ways to insure the old-age insurance for migrant workers for improving the enthusiasm of migrant workers;thirdly, strengthens the management of pension funds, to protect the transparent use of the fund;finally, by establishing effectively monitoring mechanisms on pension of migrant workers, to protect the legitimate rights and interests of migrant workers.Of course,the problem of the old-age insurance of migrant workers is very complexity, only combined the features of migrant workers and China's national,established and improved the legal system, then strengthened supervision and management, can we establish a perfect old-age insurance of migrant workers.
