The Value Of The Rule Of Law By Openness Of Government Affairs And It's Realization Approach

As the general reign strategy of the Party,'the rule of law' was approved as a basic national policy and regulated in'The Constitution of People's Republic of China'by National People's Congress.'The rule of law' requirs excuting government power legally and effective supervising to state public power, which means that public power should be enforced in an open, normative and specific way. Factually, executing administrative power legally refers to control and constraint power by law. On the background of continuing modification of socialist domestic legality construction in China presently, as the specific way to acknowledge government information for citizens, legal entities and other organizations as well as the aim of establishing an open and transparent government in government's structural reform, the openness of public affairs becomes a vital measure and aspect of socialist'The rule of law'country construction, which is of practical significance to preventing corruption as well as'Sunshine Government'construction. The openness of public affairs is an important measure to prevent corruption and of great significance to the current political and economic development and administrative reform in China. As the realizing way of socialist domestic legality and the requirement of promoting the rule of law in China, openness of government affairs and the socialist domestic legality construction promote and restraint mutually.This paper analyzed the values of the rule of law from the perspective of describing the basic theory of government affairs openness. On this base, the paper tried to find out the feasible approaches to achieve these values, then to gradually establish and perfect Chinese characteristic government affairs publication system, which aimed to realize the inherent value of'The rule of law'. We can learn a lot from western countries''relatively perfect and mature publication system of government affairs. Based on this method, the thesis explored the connotation of openness of government affairs and its value to the rule of law in China. By summing up the characteristics and rules of foreign countries'openness of government affairs as well as analyzing the problems exsisted in openness of government affairs in China, the thesis explored to give some suggestions on modifying and perfecting the constitution of openness of government affairs in China.
