Analysis And Discussion On Guardianship Problem Of Left-behind Children In Rural China

China has speeded up urbanization in the past years, it is a strong appeal to many rural workers flooding into big cities for develoment.Urbanization promote the development of economy and improve the standards of living, it cause a series of social problems at the same time. As a special weak group,left-behind children in rural China has attracted more and more attention with increasing number every year. Family function hardly play a significant role in rural areas because of a long absence of rural workers as parents. The basic rights of Left-behind children in rural China came under infringement in various degrees. Many local government make an effort to assure life and development of left-behind children in rural China by many ways, but it just arm at local region and need more attempt. Legislation not give detail and effective rules about how to protect right and interest of many left-behind children in rural China, so many events that harm the interests of the left-behind children in rural China happened and can't be stopped and prevented. It is no doubt that it will hinder the harmonious development of society and process of new country construction. It it is urgent for the current law to solve that improve and perfect the guardinship system and strengthen the protect of left-behind children in rural China.Left-behind children in rural China face many difficulyies, it is a problem not only family things but also country and social things. If the problem can't be solved effectively, disparity between city and rural area must be increased and hinder the development of the rural economy badly. urban economy had been speeded up under the contribution of these rural workers, but it can't be realized at the expense of right and future of left-behind children in rural areas. Attention of society and support of government just protect the development of some left-behind children in rural provisionally in special areas, they can't solve general problems all of the rural areas. This problem can't be sovled just by law, progress of economy and perfection of theory are also key elements for improvement of left-behind childer in rural areas, it is a long and complicated historical process. Law just protect them from some specific aspects and cut their injury as far as possible. To combine with present situation, we need to deliberate on perfecting the related legislation and giving more suppore to left-behind children in rural China.This paper described some defects in present guardianship system by all-around analyzing typical case and offer reasonable proposal to related system according to Chinese actual conditions based on foreign acvanced system. We hope it is of help to improvement of left-behind children in rural China.
