Research On China's Law Enforcement On Food Security

"Hunger breeds discontent, to food security for the first."There are frequent accidents happened on China's food security in recent years, which seriously affects people's lives and physical health and results in that food security has currently become a hot issue concerned widespread. Food security is a major issue of people's livelihood and plays a vital role in China's economic and social security, stability and development. It has become a focus for representatives in the all levels of"two sessions"each year and even it is raised into the Prime Minister's government work report in 2009.The problem of a large number of food safety accidents is closely related with the weak law enforcement of national food security. The key to develop a good environment for food safety needs scientific and effective enforcement. This paper attempts to have a systematic study on China's food safety enforcement system from the perspective of administrative, hoping to make a contribution to solve China's food safety problem in the way of administrative enforcement and create a good environment for food safety.This paper analyzes the current situation of China's food safety enforcement and its regulatory system and also makes the study on the administrative law enforcement system in some developed countries and proposes a conception of fulfilling China's food safety enforcement system. Here are three parts of this paper as follows.The first part is to present the current situation and regulatory system of China's food safety enforcement by analyzing some of the major food safety incidents in recent years and food safety enforcement system from Food Safety Law by The People's Republic of China (hereinafter referred to as Food Safety Law), which comprehensively elaborates the shortcomings and inadequacies in the law enforcement on food security.The second part is to make a research on the system of food safety enforcement in the legal text, which can be called"foreign experience". It conducts a study on the food safety system of administrative law enforcement from the United States, European Union and Japan and summarizes their experience in food safety enforcement. The third part is to propose the idea of improving China's food safety enforcement system by learning from foreign experience and combining with the actual situation in China, including perfecting the legal basis of China's food safety enforcement with the guide of Food Safety Law, reforming the enforcement system of China's food safety by taking"comprehensive law enforcement"as the core, regulating the enforcement actions of China's food safety by aiming for"science of law enforcement", and establishing the responsibility system of China's food safety enforcement by taking"individual accountability combined with the state compensation" as its basic principle.
