Research On The Legal Incentive Mechanism Of Wind Power In China

The development of wind power is an important measure to guarantee energy security , response to global climate change and protect the environment. In recent years, under encouragement of relevant policies and regulations, the development of wind power in china has obtained gratifying achievement. Especially, the promulgation of " the Renewable Energy Act of 2005" promotes greatly the development of wind power of our country .With the rapid development of China's wind power , the wind power-related legal research deepens day by day , and there have been a lot of important theoretical results. Current relevant researches focused on the following aspects: Firstly , the development of the legal system of wind power has been discussed from the perspective of the whole renewable energy law. Secondly, though drawing on the successful experience of the developed countries such as Denmark,Germany, the suggestions of the legal construction of wind power have been made. Thirdly, promoting wind power development of specific legal mechanisms has been in-depth studied. In the above-mentioned three aspects of the study, the first and second aspects of the study are relatively more in-depth, while the third aspect of research is rarely been involved. The paper attempts to make up for this deficiency. Through comprehensive, systematic outline and analysis of the mechanism of wind power laws , this paper tries to build a legal mechanism with Chinese characteristic, which can promote sustainable and healthy development of wind power on the basis of drawing on mature experience of foreign countries.In general, the paper is divided into three chapters:The First Chapter: Wind power Overview. This chapter firstly gives a brief overview of wind energy and its characteristics, and then describes the actual status quo and prospect of wind power in china, and explores the necessity and significance of the promotion of wind power development further.The Second Chapter: China's Status quo on the Legislation of Wind Power and Analysis of the Main Legal Mechanism. This chapter firstly introduces the status quo on the legislation of wind power generation, then makes comprehensive, systematic outline and analysis of the mechanism of wind power laws in China, and focuses on analysis of the shortcomings and reasons.The Third Chapter: Thinking About Improving the Legal Incentive Mechanism of wind Power in China. This chapter makes, for the deficiencies of existing mechanisms, futher suggestion about improving the legal incentive mechanism of wind power in China.
