Since China's Reform and opening-up, the population is floating frequently, especially in the developed area. The floating population has contributed a lot to the social and economic development, but also brought about series of social problems. Due to the factors of system and resources distribution, great discrepancies occur between the floating population and the local residents in the field of income distribution, social security, education. The floating population is difficult to integrate with the mainstream of the society, and impose great impact and pressure on the social administration and social services.Based on the analysis of the social problems, the construction and characteristics of floating population in Guangdong Province, this thesis focuses on the servicing and legislation concerning floating population in Guangdong,and has a good study of Guangdong provincial related legislation history and system innovation. The floating population has experience 3 phases, free floating phase, strict control phase and prevention-style administration phase, which emphasizes the prevention against the floating population, focus on the restriction and control, and pays more attention to the security administration, but neglect the provision of social service and safeguarding the rights & interests of the floating population.Nowadays China has entered into a new phase of administration and servicing of floating population,so Guangdong province has carried out series of innovation on related legislation, which emphasizes the idea of servicing, establishes the system of residence registration and certificate, and secure the public service and the rights & interests of the floating population. But due to limitation of in legislation right, Guangdong provincial legislation can not avoid the constraint of House Holding System and can only provide limited public service for the floating population. However, the administration and servicing of floating population is a systemic social project, which can not be solved only by local legislation. The national legislation shall adopt the concept of people orientation, study and adopt the successful experience of local system reform & innovation, break down the various rules and regulation which constraining free population floatation, and push the reform of related systems including House Holding system steadily, which is the only way that can solve the problem existing in floating population.
