On The Legal Protection Of Minority Rights

The protection of minority rights is one of the most important aspects in the international human rights'protection. However, there still exist much more disputes on this subject, for instance, the definition of minority. Therefore, in order to maintain minority rights effectively and establish the harmonious social order, even the stable political situation, pursuant to Convention concerning International Protection of Minority Rights, China should strengthen and improve the relative legal systems in legislation, judiciary and executive department focusing on protecting minority rights. Meanwhile, the efforts and progress for protecting minorities varies from country to country in worldwide, particularly China's legal system and enforcement are far from satisfactory in protecting minorities.This paper mainly probes into the legal protection of minority rights in four parts. The first part of the paper analyzes the controversies over the concepts of minority and minority rights home and abroad, refining the understanding of the concepts from the author's perspective. The second part analyzes the theoretical basis of protecting minority rights to prove its legitimacy and necessity. The third part describes the current situations home and abroad of protecting minority rights, and discusses the content of minority rights, in addition, analyzes the problems in the protection of minority rights in our country. In the last part, the paper discusses how to solve the above-mentioned problems and improve the legal system related to the protection of minority rights.
