Our medical health legislation refer to the United States and other developed countries, mainly in cities, with the increasing of rural medical disputes, the current health law in judicial practice hard to implement and execute. Perfect rural medical disputes, is useful to safeguard farmers'rights, help basic-level organization to better health for the farmers, maintain social stability.In recent years, China's rural medical disputes emerging situation has hampered China's medical and health undertakings. Specific mainly in three aspects, first in the number of medical disputes, as society changes, the deterioration of doctor-patient conflicts, China's growing number of medical disputes in recent years, the growth of medical disputes in rural areas is particularly evident, author interviews learned, rural medical disputes in the last two years, the growth rate as high as 30%. Second, rural health laws and regulations is not complete, the current rural medical and health legislation, including legislation of rural health workers, rural health facilities in rural health care legislation and legislation。And in August 2003 by the State Council promulgated the "Regulations of rural doctors practicing" is the only one higher-level legislation. Regulations promulgated by the Ministry of Health, including the 1989 "Regulations rural birth attendants," 1994 "basic standards of medical institutions (Trial)", 2002 "On strengthening the rural health personnel training and team building," and "on the rural health sector the views of reform and management, "and some local regulations. They are widespread and relatively fragmented and age old problem, which in the actual practice of dealing with medical disputes in rural areas the lack of guidance. Finally, the rural medical institutions as inadequate investment, facilities, poor standard, relatively low medical technology, management, and other reasons are not standardized, and the cities more easily lead to vicious incidents. The vicious incidents, on the one hand a more sharpened the conflict between doctors and patients. On the other hand, due to the huge medical compensation, often lead to capital shortage of medical institutions into operational difficulties, so the local people are guaranteed basic health care is difficult.
