The Analysis Of The Peasants' Right Of Development

The developing right is a new type of human rights, which is principal and fundamental in the human rights system. It is the place for other human rights to subsistence and merge and also the foundation of human rights mansion. The survival right is the foundation of the developing right, while the developing right is the extension and distillation of the survival right. The developing right's characteristic features are as follows:successive,universalistic,dynamic,goal directness. The core values of the developing right which is the right advocated by the weak toward the society are justice and equality. In the long run, the problem of Chinese agriculture, rural areas and farmers is the developing problem. The developing right of the peasant is the right which the peasant as the individuality and collectivity freely take part in the economicn,|political,cultural and social life and enjoy the developing benefit from these.|The protection of the developing right of the peasant has an important significance that can protect the rights of the peasant, enhance assurance of the peasant rights, strengthen the peasant's sense of identity, realize equality and justice of society, promote the market economy in rural, construct a new socialist countryside, unit development between urban and rural, establish the harmonious society. The peasant is the biggest weak group of Chinese citizen, whose developing degree and situation has a decisive function on the development of agriculture and rural areas. It also relates to the strategic problem of our country's development and the whole social developing situation. In reality, the protection of the developing right of the peasant lacks seriously. To analyze the reasons, we find that the main reasons are as follows:the restraint of dual system, the lacking of government function, the shortage of protecting organization, and the weakness of right sense of the peasant. The author think, to strengthen the protection of the developing right of the peasant, we should firstly abolish the dualistic household registering system, establish the constitutional status of citizen's developing right in "the basic right of citizen" or in the rule of "basic human right" confirm the individual developing right of the peasant, and formulate special protection law of the developing right of the peasant; Secondly, strengthen the governmental function, increase financial inputs in rural areas, innovate the mode of management and build a service-oriented government; Thirdly, we should conduct peasants to protect the right through their own protecting organization, ensure an early recovery of the peasant's association,promote the self-administration of villagers; At last we should cultivate a new concept of the peasant, innovate peasant education system, raise the peasant's educational level, enhance the peasant's awareness of law and ability of protecting right.
