The Research On Rural Residential Right Registration Question Of Changsha

Land is the source of all existence and production, and rural residence lays foundation for livelihood of the hundreds of millions of farmers.China's land use rights registration system is the product of planned economy and the commune movement.With the land reforming, market economy goes in width and depth, industrialization and urbanization is moving forward, China's existing rural residential rights registration system can not meet the development needs of the market economy. As a pilot of resource-saving, environment-friendly society, Changsha can promote the urban and rural development, advance a new socialist countryside construction, innovative mechanisms,first to perfect the system of rural residential rights,strictly residential land management, according to the law to protect farmers residence the right to use,and gradually establish a unified, integrated land registration system premises.A field study has been made to investigate the situation as to residence land registration in towns of Changsha Pilot Zone,such as Jingzhou Town, Hanpu Town and Yuchangping Town.The finding indicates quite a few existing problems,such as residential registration laws and regulations are not perfect, residence registration procedures is very complicated, registration rate is very low,registration information can not query by public, registration staffs are insufficient.Based on empirical research, we collect and sort out the main academic research results on rural residential right registration system,absorb jurisprudence,economics, sociology and other disciplines of knowledge,put forward a sound proposal on rural residential right registration system of Changsha:we should make unified efforts in land registration,and establish a system of compulsory registration of rural residential right;we can first establish land registration agency that integrated urban and rural,housing and land in Changsha,strengthen the power of grass-roots organizations Residence Registration,facilitate the registration of farmers residence;We should strictly management the register system,facilitate public inquiries;notary as pre-registration agency review process,the establishment of substantive review the main form of secondary review of the review methods,and establish a fair compensation system for error registration so as to protect the legitimate rights and interests of homesteaders;Finally,Registration agencies should vigorously improve the quality of personnel, establish a scientific and rational post inspection system,strengthen the supervision of the registration.
