Reasons For Drug-related Crimes And Strategies Of Prevention In China

As for our country, studying drug-related crimes is an actual and urgent task. The thesis is supplied to put forward the study modes of natural reasons for drug-related crimes, social reasons and individual reasons, by learning experience and strictly following analyzing path of criminology on cause of criminality, on the base of defining the concept of drug-related crimes, so as to perfect the theoretical research of drug-related crimes of our country further. In the thesis, the problems on drug-related crimes in four chapters on the base of sample survey and empirical study are expounded.Part-1 is the study on the relevant concept of drug-related crimes. In the first section, it is mainly analyzed the concept and characteristic of drugs, defined drugs from broad sense and narrow sense, and pointed out that drugs have drug dependence, perniciousness, illegality and value characteristics. In the second section, it is mainly expounded the characteristics of drug-related crimes'concept. On the affirmation of the concept of drug-related crimes, the author integrates the definition in international and inland law circles, and put forward how own concept; taking the outward manifestation of drug-related crimes and the links it lies as the standard, the author concluded and analyzed eight different kinds of drug-related crimes. During the analysis of the characteristic of drug-related crimes, the author analyzes human factor, region factor, criminal method, method factor, and identification of evidence of drug-related crimes in detail.In Part-2, it is mainly expounded the current situation of drug-related crimes in our country. In the first section, the performance in four aspects of drug-related crimes in our country influenced by international environment is discussed: the number of cases of drugs investigated and unearthed jumps, as well as the number of drugs seized; the number of criminals related to drugs arrested jumps; the number of people taking drugs increases, with great harm; the amount of the drugs inflow overseas is great. In the second section, it is mainly analyzed the organizing forms of drug-related crimes, pointing out that there are different kinds of forms of drug-related crimes in our country and the net of drug-related crimes is throughout of the country. In the third section, the methods of drug-related crimes are analyzed, emphasizing the serious trend that drug-related crimes are developing towards gangdom organization.In Part-3, the reasons for drug-related crimes in our country are mainly studied and the natural reasons are particularly discussed, social reasons and individual reasons of drug-related crimes. In terms of natural reasons, the discussion is mainly carried out in geogen and historical factor. In terms of social reasons for drug-related crimes, macroscopic social factors, economic, cultural and social factors of drug-related crimes are analyzed firstly, and secondly, adverse effect brought by family environment and school environment is discussed, which are closely related to the criminals.The prevention strategy for drug-related crimes of our country is mainly put forward In Part-4. In the thesis, it is put forward the active strategies for drug-related crimes mainly in four aspects. In the first section, the strategy of legislation from the angle of perfect and sound drug control criminal law is put forward. In recent years people under age involved in drug-related crimes are increasing, therefore it's suggested that push drugs of the second piece in 17th item of Criminal Laws should be loosened construction, what's more, in which the reason for heavy penalty in attacking drug-related crimes: firstly, with the advance of quality-oriented education, at present those who have reached the age of 14 but not of 16 possess the same discrimination ability as the adult in terms of learning drug-related crimes, therefore in drug-related crimes they should undertake the same criminal responsibility with the adult. Secondly, as for drug-related crimes, it's historical tradition to follow the heavier punishment principle. Thinking from the angle of demonstration effect and educational function of punishment of laws, adults should be punished heavier. Finally, it accords with the principle of criminal laws. On account of the fact that phenomenon of taking in drugs is serious, it's suggested that crimes of taking in drugs, injecting drugs and money laundering in drug-related crimes should be added in laws, meanwhile cases of drug-related crimes should be investigated secretly with criminal procedural law, as well as the legality of encouragement. In the second section, adopting prevention measures for drug-related crimes from drug control and prevention education is mainly discussed. Firstly the content of prevention education of drugs should be clear in four aspects: propaganda and education of common sense of drugs; law for drug control; the propaganda and education for drugs'harm on society and the propaganda and education of drug defense. Secondly, it's necessary to distinguish levels, and put Suppressing Drug Law into practice strictly. In the third section, the work that should be done in terms of rehabilitation is mainly discussed, and concrete methods in terms of making clear the number of people who take in drugs, establishing nontoxic environment and strengthening structuring of rehabilitation organization are given. In the fourth section, many measures and concrete steps for attacking drug-related crimes are expounded, which should be carried out in three aspects. Firstly, be on guard carefully, control the drug's entering, and cut the source of flush drugs. Secondly, carry out international cooperation actively, so as to increase the success rate in attacking drug-related crimes. In terms of carrying out international cooperation, three aspects should be followed: the international political cooperation led by the government should be strengthened, international police cooperation should be actively carried out and perfect international judicial assistance system. Finally, techniques of drug control should be improved so as to strengthen the ability of attacking drug-related crimes.
