The situation of all schools operated by government dates back to the period from September, 1952 to 1954, when all the private schools were taken charge of by government. To education, government is the investor, the manager and the founder. As a result, it leads to the constant lack of educational fund, the sharp contradiction of educational supply and demand, lower management of schools in the long term and low education quality. So it can't meet the needs of the development of social economy. With the propulsion of the economic system reform and the establishment of the market economic system, the pluralist system came into being in which all those with abilities can operate schools. All varieties of schools have been set up around the country, which meets the need of education and lessens the contradiction of educational supply and demand. However, because of the shortcomings in the current school system, varies of problems about private schools have turned out. In order to keep up with the new world of knowledge-based economy in the new century, we should soon make private education laws in order not only to secure the status of school corporations and the right of independence in operating schools, but also to secure the benefit of the operators. Besides, we should establish modern school system, prescript their operating behaviors and accelerate the abiding development of education career. This thesis includes four parts. In the first part, the author explains the meaning of school-operating system, In the second part, the author analyses the features and shortcomings in the current system. And then, in the third part, the author probes into the situation and problems of private schools. Finally, combining his own experiences, the author calls for private education laws, protocols and policies to go with them. The author suggests that private schools develop properly both in quantity and quality, ie. speed up in the areas with fewer private schools and slow down in the areas with so many private schools. In this thesis, a large part is made to illustrate modem school system. The author seeks for the prescription and development of private schools based on modem school systems under lawful conditions to form the situation of public schools and private schools existing and developing together at the same time.
