A Study On The Condition And The Countermeasures Of Olympic Intellectual Property Rights Protection In China

The modern Olympics have made a lot of creative intelligence products including the knowledge of Olympics, the relationship of people, the system of organizing and the system of property during it's more than 100 years development. The modern Olympics have to change it's model of management in order to survival because it has stuck into a financial crisis since 1980s, it sold it's intelligence in the whole world and make much more success, however, this model brings another question that many merchants infringe the intelligence privilege of Olympics and it getting more and more serious in this years. We need a new method to protecting the intelligence privilege of Olympics. Different countries take the different method in order to protecting the Olympic intellectual property rights because each country has many differences in politic, economic, culture and law. Base on many methods including literature, analysis, induction etc, the author analyze our countries status in quo in protecting the intelligence privilege and bring forward the new methods to improve this status. The author hopes this article's theory can benefit the Peking Olympic both in theory and praxis. The whole article is made up five parts. The first part is the pandect of this article including the contents, the basement, the intention and the methods. This article's main contents is what is the Olympic intellectual property rights, how to protect the privilege and the problems in protecting. The basement of this article is the Olympic intelligence privilege is getting more and more valuable and the problem of infringement is getting more and more serious since 1984. The intention of this article is to find a suitable measure to protect the Olympic intelligence in 2008. The significance of this article is to advise our government should to take the new and strong measures to protect the Olympic intelligence during the Peking Olympics in order to improve our country's status in the world and achieve the goal which we had consented. The researching methods include literature, analysis, induction, materialism and etc. The second part is the general understanding about the intelligence privilege and the standard of protection in our country. The protecting level of intelligence privilege is suitable with it's development status in politic, economic, culture and education. As a special part of the intelligence privilege, Olympic intellectual property rights is development under the circumstance of the protecting status in intelligence privilege developing very fast with our economy growth. We cannot continue our study on the protecting Olympic intellectual property rights until we know the whole protecting status in our country. The third part is the understanding about the definition of Olympic intellectual property rights. The author has a detailed analysis on the definition, character of Olympic intellectual property rights on the foundation of other persons. This part is also the foundation of this paper. The study on how to protect the Olympic intellectual property rights in our country is not enough and some definition is conflictive and not clear. The author not only point out the differences between the Olympic intellectual property rights and the general intelligence privilege, but also make clear some definition boundary and expound the necessary and the urgency of protecting the Olympic intellectual property rights. The fourth part is the analyzing on the protecting status in Olympic intellectual property rights in our country. The author finds that there are problems in protecting the Olympic intelligence privilege through analyzing the practice of legislation and execution. The study on the legislation and execution is not enough and cannot supply enough protection. The fifth part is the result of the paper.
