Research On Managing The University By Law In China

University is the epitome of the society. The management of university involves a lot of aspects. Managing the country by law is the basic strategy that the Communist Party of China leads the people to run the country, managing the university by law is the fundamental guarantee of boosting the development of higher education in China. This dissertation will combine four methods (such as analysis on history, comparative study, integrated case study and induction) and three principles (such as higher education, history and science of law) to carry out theoretical explanation and practical research for research on managing the university by law in China.The dissertation compares the history and current situation of Chinese university and advanced countries. And it points out the deficiencies and questions that existing in the course of managing the university by law. i ) the current higher education legal system is not well defined, ii) The high educational legislation lags behind, the foundation of managing the university by law is weak, iii) Education laws are not fully observed or strictly enforced, supervision is lax. iv ) The legal system in university is not well established, v ) The legal concept of teachers and college students are not strong, vi) Higher education legal relief system is not well defined.The dissertation puts forward the suggestion on managing the university by law from two aspects: i )Propose the suggestion on the aspect that the country manages the university by law: Foster and develop law culture of higher education;Strengthen the educational legislation, Improve and perfect the legal system of higher education;Set up a set of complete education law enforcement mechanisms;Perfect supervision mechanism, ii )Strengthen the university's own legal construction: Double efforts to publicize legal knowledge;University's administrator should establish the idea of managing the university by law;Strengthen university's students management institutional improvement;Enforce the management on teacher;safeguard teacher's rights and interests;Act in accordance with the law, safeguard the legitimate rights and interests of the university;Run the university by combining the rule of law with the rule of virtue.
