The statue of a university has tremendous importance to not only managing university in accordance with law, carrying out the autonomy of running a university, but also the construction of modern university system. With the thorough development in the reform of the management system of higher education, statue of a university has become a significant issue in college education and college management, and is further brought into focus of the society currently. As a contemporary issue, it is a truth among the theorists in China that the theory research has lagged behind the practice. In the past several years, although many achievements have been made on the statutes of the universities in mainland China, however, there have also been a great many problems in both their quantity and quality because of shortage of successful experiences and theoretical guidance. This severely restricts the development of universities in Chinese Mainland.This thesis is a comparative research on the statutes of the universities in Hong Kong and mainland China. The system of the statutes of the university has a long history in Hong Kong. Abundant experiences have been accumulated, a relatively perfect system developed, and worldwide attention aroused. As an indivisible part of The People's Republic of China, Hong Kong and the mainland are derived from the same origin and imbued with the same spirit. They are naturally close in cultural background and social attitude. All of these help to form compatibility in the statutes of the university. Analyzing the similarities and differences of the education legal system under different culture backgrounds has quite an importance for building and improving the system of the statutes of universities in china, as well as advancing the development of the mainland universities.This thesis consists of 6 parts, including four chapters, an introduction and a conclusion.The first part is the prologue. It mainly introduces the related definitions and differentiation, literature review, the significance, purpose and the method of this research. It also analyses the necessity, the feasibility and the dimension of this research. The second part describes the historical development and present situation of the system of the university statues in both Hong Kong and the Mainland. The third part mainly adopts the comparison research method and chooses the following three dimensions for comparing and analyzing: the constitution, the content and the legal status of the statutes of the university. On the basic of the comparative analysis above, the fourth part is analyzing the characteristics of statutes in this two different parts of China. It points out that the biggest differences are the idea, the nature and the content, and the reasons are also analyzed. The fifth part provides the countermeasures of building and improving the system of university statutes on the basis of the analyses above. The countermeasures includes following parts:Firstly, enhance the knowledge of the university statute and enhance the construction of it;Secondly, make clear various relations of right in the statute of university, emphasize the status of academic power in the statute of a university;Thirdly, strengthen the criterion on constitution of the statues of the university, improve the legal status of the statutes of a university;Fourthly, strengthen the research and international communication on the university statute.The sixth part is the conclusion. It mainly illustrates the related aspects and presents a bright future of the statute of university in mainland China.It is hoped that this research will be helpful for knowing something about ordinance system of Hong Kong university, and for establishing and improving our higher education evaluation system.
