The Research On Legal Problems About The Prevention Of College Unexpected Events

Since the beginning of the 21st century, there have been endless unexpected events. As former United Nations Secretary-General Kofi Annan said, "Our world nowadays is more vulnerable than before." In China, social transformation is accompanied by education reform, which makes the development of colleges and universities increasingly prominent in society but at the same time increases more uncertain factors. Unexpected events also break out in universities at times. In order to ensure the development of colleges and universities, student life and property safety, governments and universities of all levels have to make every effort to strengthen the construction of a relative efficient legal system to prevent the unexpected events in colleges and universities.The prevention of college unexpected events means: States, all levels of government, educational administrative departments and universities take various effective measures before the occurrence of unexpected events for eliminate hidden dangers of unexpected events; or make adequate preparations before the start of the unexpected events, such as preparations of thinking , organization, material and system, for prevent the expansion of unexpected events and minimize the losses caused by sudden incidents. The legal basis for the prevention of college unexpected events including the Constitution, civil law and administrative law. Theoretical basis of the Constitution is that the basic human rights of citizens of the right to life and property; theoretical basis of the administrative law is that the prevention of college unexpected events is a part of State emergency prevention system; theoretical basis of the civil law is that college safety obligations. Foreign country such as The United States and Japan have an effective legal system on the prevention of college unexpected events, however, the law on the prevention of college unexpected events is not perfect in our country. The prevention of college unexpected events must rely on the protection of the rule of law. Prevent college unexpected events in the practice of a lot of problems,such as lack of management bodies and psychological intervention mechanism. In view of the above problems,We must develop "Campus Security Act", set up campus police system and given enforcement powers, and establishing legal psychological intervention mechanism ,etc.
