As a new thing in the development of china's higher education, independent institute is a major policy made by the Chinese's government for the promotion of the popularization of the higher education. The independent institute as a new and unique mode, it is not from their birth to 10 years. But the positive impact upon China's higher education is perfectly obvious. Just like any new things, however, no ready-sets to use, no off-the-shelf pattern to find, no experience to learn, all are groping in the practice, therefore there are a lot of problems in the process of development. The problem is due to the China's vague policy or system upon independent institute or lagging behind the reality. That is, there are many issues in the current policy of the independent institute.This paper attempts to adopt perspective of policy analysis to analyze such issues as the background, process and function of the independent institute policy, groping the reasonableness and science of these policies and trying to provide service to scientific decision-making of independent institute.The full paper is divided into the following three chapters. The first chapter explores the background and significance of the policy upon independent institute. Through analysis, we can see the introduce of the independent institute policy has its historical inevitability and practical significance, which accelerates the sustained and rapid growth of independent institute and speed up the process of popularization of higher education.The second chapter focuses on the problems existing in the theoretical and practical aspects of the independent institute policy. It discusses mainly from such four aspects as the nature, "independence" (the relationship with the mother -university), the leading institution and the property rights. Meanwhile it analyzes the reasons of these problems in the process of implementation and it is concluded that the imperfection of policy and the distortion of the implementation are the main reasons.Chapter three is the main conclusions and policy recommendations. It draws such three conclusions as the nature, reasonableness and system missing of the independent institute upon the basis of above researches. It suggests that China should improve the "private education promotion law" or enact the "independent institute law" on the basis of the "private education promotion law" as soon as possible. We should establish the independent institute as a form of non-government school as well as shareholding so as to ensure the rights and interests of the different attribute of the independent institute.
