Constitutional society is a key sign of modern country. Rights are the soul of law. If rights are not understood seriously, the law cannot be understood deeply. Generally speaking, the importance of rights is strengthened continuously and increasingly in modern society. Rights, particularly education rights, place a more and more important position and function in modern civilization. The ethic of education rights is the basic objective principle and requirement relevant education subjects should obey when they are enjoying education rights by law. Under the background of advocating the governing of countries by law and moral values, educational rights ethic is attracting more and more attention. Though education rights ethic is regarded as a subject of practicing education rights, rare people have studied on it. The practice of teaching with laws shows educators that the study on education rights ethic has become an important subject in educational legal research. Through the analysis of connation of education rights ethic, the thesis aims to further analyze theoretic basis of education rights ethic in order to build an effective mechanism of education rights ethic so that the relevant subject understands and practices education rights correctly, the education rights get the expected result, and educational business is developed healthily and orderly. The study includes the following four parts:The introduction: It elaborates on the origin of the study and the study scope from home and abroad, and then gives a comment. The basic content and way of thinking are illustrated. The first part: This part emphasizes on general introduction of education rights ethic. Through the analysis of rights, power, education rights and power, ethic, the connation of education rights ethic is revealed. The relation between education rights ethics and education rights morality is made clear, on the basis of which the regulating, coordinating and encouraging function of education rights ethics is analyzed.The second part: This part stresses the discussion of the theoretic basis of education rights ethics. It analyzes that legal education rights represent the basic spirit of equality and freedom embodied in contractarianism, the viewpoint on supreme goodness and happiness in Theory of Happiness, the two ingredients of mentality and benefit in Theory of Balances. All these possess ethic connotations and show that education rights not only have legality, but also ethic.The third part: This part emphasizes on the discussion of ethic mechanism of education rights. The ethic mechanism of education rights includes the formation of education rights ethic mechanism, that is, relevant subjects'appreciation of education rights ethic, education rights ethic consciousness, and education rights ethic heteronomy. The development of ethic mechanism of education rights which consists of the ethic recognition, character and self-discipline of education rights. The ideal state of ethic mechanism of education rights which involves internalized education rights ethic, the ethic rationalism of education rights and the ethic freedom of education rights. Fully understanding the building of education rights ethic is such a gradually deepening and improving process that the relevant subjects should understand and practice education rights and maximize education rights benefits in order to promote healthy education development and realize social harmony.
