Research On The Construction Of Administrative Rule Of Law From The Perspective Of Morality

Construction of administrative rule of law is an important part of the build socialism country under the rule of law.As socialism with Chinese characteristics enters a new era,the construction of administrative rule of law is facing such prominent problems as lax law enforcement and corruption in law enforcement,which affect and restrict the process of the construction of administrative rule of law in China.To solve these problems,it is necessary to reflect and respond from the perspective of morality and value,because administrative behavior is not only related to administrative rule of law,but also related to administrative rule of virtue.In the process of construction and development of administrative rule of law,combine legal force and moral consciousness,combine law and morality,can supplement each other,can not only find the balance between law and morality,but also restrain the administrative power,strengthen the system construction,and enhance the sense of urgency in the construction of administrative rule of law.This paper adopts the methods of literature research and cross research to systematically examine the practice of administrative rule of law construction from the moral perspective,and on this basis attempts to give ethical countermeasures,so as to better promote the construction of administrative rule of law in China.First of all,start from the connotation and main contents of construction of administrative rule of law,on the basis of macro to grasp,discuss the necessity and feasibility of morality entering the construction of administrative rule of law,because of each link are more or less in some lack of moral problems,it is necessary to play the role of morality to reach the ideal state of administrative rule of law construction,and morality can provide value basis for administrative legislation,ethical regulation for the application of administrative laws,and moral guarantee for all parties to abide by the law,all these features show that morality can provide strong support for the construction of administrative rule of law;Secondly,in the administrative legislation link elaborated the necessity of the creation of the administrative good law,and try to put forward the moral path to generate the good administrative law,including the establishment of a conscious awareness of the administrative good law,the moral value system to guide the creation of the administrative good law and concern about the procedure and form of administrative legislation rationality and so on;Thirdly,in the application stage of administrative laws,the importance of administrative law enforcement and administrative justice and their specifie moral characteristics are discussed,try to set the ethical path of applying administrative law,such as setting up humanized administrative law enforcement concept,following proper administrative law enforcement procedure and ethical regulation of administrative discretion;Finally,it explores the significance of law-abiding morality of all parties in the construction of administrative rule of law and the cultivation path of law-abiding morality of all parties,only stick to legislative ethical principles,improve the supervision of legislation,enforcing self-discipline consciousness,perfecting the judicial moral constraints,establish civil law-abiding consciousness,strengthen the legal belief consciously,to ensure the rule of law construction can really build up and effective operation,and promote the development and perfection of administrative rule of law construction in China,to maintain social harmony and stability and healthy development.
