The Basic Legal Issues Of Non - Governmental Environmental Organizations

With the continuous development of China’s economy and society,environmental issues have become increasingly prominent. In the process ofprotecting the environment, the government and the public have recognized relyingsolely on the power of relevant administrative departments is completely inadequate.In recent years, non-governmental environmental organizations have relied on theirown characteristics and advantages, through theirs own efforts, and activelyparticipated in the environmental protection work in the past, have won thegovernment and the public recognition, environmental protection has become anintegral part of the work force. However, the rapid development of China’snon-governmental environmental organizations in recent years, with a challenge toproduce the relevant legal system, the problem of existing laws and regulations cannotmeet the practical needs of a growing problem. Therefore, the discussion ofnon-governmental environmental organizations studied a series of legal issuesinvolved in environmental protection is of practical significance.In this paper, the basic legal issues of environmental non-governmentalorganizations systematically have been studied. The first part explains the legitimacyof the definition of non-governmental environmental organizations, environmentalnon-governmental organizations to play a role in protecting the environment,significance and non-governmental environmental organizations generated, in order tomake the basic concepts of non-governmental environmental organizations and theirclassification explicit. The second part analyzes the legal plight of China’snon-governmental environmental organizations existed in what reasons. Mainly fromthe non-governmental environmental organizations registration management system,to achieve the right situation, three major legal mechanisms in cooperation with thegovernment classify instructions of the root cause of the problem clearly. The thirdpart describes the experience of foreign non-governmental environmentalorganizations in legal protection and legal dilemma for China’s non-governmentalenvironmental organizations exist, an improved and improvement suggestions. Thisstudy aims to be able to improve and perfect the legal system of environmentalnon-governmental organizations and play a positive help.
