Combined with the theory of the relationship between the government and the market in the economic law, the successful operation mode overseas, it also makes suggestions on how to effectively raise and maintain the money to make the public rental housing legal system operates well. For example, the financial subsidy and the tax regulation are included. At the same time this paper considered that:not only the financial subsidy but also the tax regulation are all the measures that the government uses in the macro-control to solve the problem to maintain the funds of the public rental housing legal system. So, the key to solve the problem of maintaining the funds of the public rental housing legal system is that the government needs to take advantages of all kinds of measures well and scientifically in the macro-control. The content of this paper includes three parts:The first part raised the problem of maintaining the funds of the public rental housing. The definition of the legal system of public rental housing is given firstly. The status of public rental housing legislation in Chinese legal system is introduced after. Elaborated in accordance with legislative provisions constitute the legal system of public rental housing. One key component is the maintenance funding, which leads to the discussion of maintenance funding in the legal system of public rental housing. Meanwhile, this article utilizes the macro control method, has carried on the analysis to the maintenance funding in the legal system of public rental housing. The theoretic framework has been founded for this article is very important for as follows elaboration.The second part focuses on the legislative norms of public rental housing maintenance funding issue in Kunming, and then extends to the whole country. as well as the summary and refining of practice. The absence of legislation and practice in Kunming’s public rental housing maintenance funding issue is stated.The third part is the experience during the implementation of the legal system of public rental housing in other countries and areas. The paper has described the issue so far, and the experience of successful cases is summarized. In this part, experience is mainly taken from the operation of protection housing system in US and other developed countries. Finally, some countermeasures are proposed to solve this problem.This paper holds that the thinking of the public rental housing law system should base on the basic theory of the economic law, and the theoretical aspects of macro-control economic law relationship between the Government and the market is combined to with the summary of practice, in order to put forward some suggestions and theoretical summary to the maintenance funding issue of public rental housing system in China.
