Housing is a problem that must to faced if human want to survival.It is a imperative responsibility of the government to guarantee citizens the right of residence.Since the last century,the world are undergoing to building the housing security system,our country is also actively exploring.In 2014,our government announces the ow-rent housing and public rental housing are getting together,in our country,affordable housing and public rental housing as the main security system has been basically formed.But,as China’s housing security system is in its infancy,in particular,the time of the establishment of the public rental system time is short.There are still many problems,especially in the difficult of public rental housing exit is particularly serious.Exit to the public rental housing as an important part of the public rental housing,listings is able to effectively transfer played a decisive role.And Exit to the public rental housing is related to the public rental housing is designed to be able to play a role in safeguarding at the beginning of it.It can be said that only smooth vacate houses can take the public rental housing to a normal operation.Therefore, it is necessary to study on the legal issues of exit to the public rental housing.In this paper, by using document analysis and comparative reference method,firstly, explain the public rental housing and the public rental housing exit on the legal level, focusing on the analysis of the legal connotation of the system,and using the legal knowledge to analyze the exit to public rental housing is important for the entire public rental housing system and it as a legal theory is necessity to research.And Subsequent legislative status of public rental housing in other countries and regions of the world and analysis the experience of the withdrawal,then made a summarized that the other areas of public housing exit have many advantages such as the perfect legal system, the incentive mechanism to properly, the great credit system and the management and monitoring features.They are all reference for the study of the legal system of public rental withdrawal.Meanwhile, from the legislative texts, combining local economic development, profound analysis of several typical cities of exit system, summarize the lack of laws and regulations of China at this stage, specific the exit is not perfect, such as the lack of effective incentive mechanism, supervision and management do not work and some other practical problems.Finally, according to the summary of the legaldefects, the authors focus on several recommendations legal aspects.In the construction of public rental housing withdraw legal system, improving specific exit the program, establishing a reasonable and effective incentives punitive measures and settings quit related system to the security. Making a concrete conclusion that, in order to improve the public legal defects rental housing exit,must establish a sound legal system at the beginning, gradually improving the specific program,making the formation of an effective system of incentives and penalties as well as other related legal system, and then the public rental housing can play a better role in the housing security system.
