Public rental housing,which is in support of government policies and legislation,is funded by the government or social subject.It is the new affordable housing which is facing the urban middle-and lower-middle-income housing disadvantaged groups.On the basis of the basic theoretical research for public rental housing,the thesis combined with domestic and foreign successful experience,and offered preliminary proposals to improve the specific system of public rental housing by analyzing the main problems of the legal system of public rental housing in practice,In order to solve the housing difficulties of the lower-middle-income groups and provide reference for formulating and improving the legal system of public rental housing.Based on the analysis of concept and characteristics of public rental housing,the first part compared the public rental housing with the affordable housing and the lowrent housing,then analyzed the advantages of the public rental housing system.Meanwhile,the thesis introduced the important theoretical basis for public rental housing,specifically including residential right theory,inverted U-curve theory,welfare economics theory and dual defect theory.The second part evaluated the relevant foreign legal system,especially studied the public rental housing legal system of the UK,USA and Singapore.Developed countries generally have the sound legal system of housing security and housing finance system and the specialized housing security agencies.Meanwhile the foreign can ensure the full participation of social forces in practices of the public rental housing construction and operation.All of these have reference for establishing and improving the public rental housing legal system of our country.The third part stated the status of legislation of the public rental housing legal system of our country,then according to the legislation present situation,put emphasis on discussing the problems of the public rental housing legal system such as the unsound access and exit,the land supply shortages,the limited fund procurement,the housing supply shortage,the deficient supervision and management system.The fourth part gave the appropriate suggestions on basis of the exiting problems of public rental housing legal system.In the aspect of access and exit system,we should confirm the security range,and perfect the access audit system,the mechanism of exit rewards and punishments,spot and regular check system.In the aspect of land supply system,we should perfect land banking system,change the way of land supply,enhance the land supervision strength.In the aspect of fund supply system,we should ensure financial capital investment,perfect housing accumulation fund system and the housing finance institutions,and give full play to social funds' initiative.In the aspect of housing supply system,we should broaden channels of housing supply.In the aspect of supervision and management system,we should set up the special supervisory authorities,and establish the supervision and management system.
