Recently years, in the illegal carriage issue, the Chinese government focused on improving the legal system, strengthen control, and frequently administrative law enforcement. However, illegal carriage still appears which is getting worse. Current system and regulators failed to adjust the market; rent-seeking and rent-setting spread all over the regulatory system; and lacking of public participation and public supervision are the main reasons of the problem. Illegal carriage issues are related to people’s daily traveling, life and health, the image of city, and stability of society. Obviously, it is government’s responsibility to solve that.Exploring governance issues of illegal carriage comes from the theory of Responsible Government, New Public Service, and Quality of Service Management. This article contained of law, science, responsibility, compromise, and participation.We can find out many problems of illegal carriage, including:weak concept of law, single measurement, obviously rent-seeking, the distribution of benefits dispute, and lacking of public participation. On the one hand, illegal carriage is damaging to the interests of the public; disrupting the normal development of the transportation market; affect the city traffic; threatening to the safety and legitimate rights of people. On the other hand, illegal carriage filled blind spot of the transportation, and solves the livelihoods of vulnerable groups.The writer analyzed taxi market status in Shanghai as an example in this article. Combining with City administer management theory, the writer gave substantive analysis of the problem of illegal taxi operations. Writer referenced domestic and international experience, especially the governance of the Hong Kong, and gave suggestions that scientific quantity control, gradually elimination of access restrictions, strengthening service quality management, enhancing the advice and feedback of the trade promotion associations, expanding information disclosure and public participation etc. This article also tried to give the recommendations.
