Sex and gender are different types of concepts. Sex is sexual differences in physiology, mainly embodied in the physiological structure and physiological function. Gender is a kind of social norm, influenced by various social factors,such as politics, economy, culture. Gender is based on Sex. In real life, Gender directly shows the gender roles by behavior patterns. The law plays a normative role on the shaping gender roles by offering behavior patterns to legal subjects.In ancient China, women subordinated to men. In modern society, the idea of equality between men and women rose. Equality between men and women, as a basic national policy of China, was reflected in the Marriage Law.Equality between men and women is against the patriarchal, emphasizing on the equality of the two gender groups. It objects to one gender group oppression the other. Gender equality is the promotion of equality between men and women, including the equality of the two gender groups and the equality of individual.Equality in Law undoubtedly includes gender equality. Law is an important tool for establishing and consolidating social ideology. Discrimination acts against women should be punished by laws. By legislation, enforcement, judicial and other measures, the traditional gender ideology would be broken up and the system to protect women would be strengthen.What’s more, gender equality would be immobilized by laws and be the basis to address specific issues.In the process of legislation, legislators should respect for gender differences and individual differences,consider the different needs of different gender groups and different individuals,assess the impact of enforcement, and regulate rights and obligations equally between men and women.Our laws should be eliminated gender-blind in the legislation to achieve gender equality.
