With the development of computer technology, the font industry rises. Yet the lack ofprotection of typeface and font caused many legal disputes about them. The contradictionbetween the related judicial practices recent years has also raised a lot of discussionsabout whether typeface and font should be incorporated into intellectual property law, especially the copyright law protection category.Based on the analysis of the possibility of whether typeface and font could be works——the object of copyright law, and begin with the related concept and some practice oftypical cases as well as foreign theories, I hold that the typeface and font are not strictlyin terms of full compliance with the current provisions of the copyright object, althoughin the process of recognizing works the originality is almost the only standard, yetaccording to the difference of all kinds of works and the requirements of the intrinsicattributes of different types, typeface and font could still not become the object ofcopyright works. However, on the issue of whether to offer a product the protection of intellectualproperty rights, we can say that as long as it has not been explicitly excluded and banned, according to the relevant policies and interests’ balance, there are some space to giveappropriate discretion on them. Even if it’s not suitable to be protected by the copyrightlaw, we also can use tort law and anti-unfair competition law to maintain their rights.
