The Research On Administrative License Institution For The Chinese Film Co-production

"Chinese film co-production" is an important part of the Chinese film market.However,two years after the promulgation and implementation of the Law on the Promotion of the Film Industry,the lack of cohesion of the implementation of the detailed rules,and vagueness of the relevant review procedures and standards,have brought many obstacles to the development of the Chinese film co-production industry.Due to the conflict and ambiguity of relevant policies and laws,administrative licensing applicants and law enforcement personnel are confused.This paper starts from the three aspects of administrative licensing subject,procedure and standard.In the first chapter,it clarifies the legal definition under the different sources of law of "co-production film",reviews the process of the establishment and improvement of administrative licensing institution.In the second chapter,it investigates the Issues of Administrative Subjects' Cooperative Governance and the Legal Status of Chinese Cooperative Film Production Companies from the Perspective of Administrative Licensing,and give the recommendations for implementing authorization and application avoidance.The third chapter discusses the opaque and unreasonable review procedures of the current co-production film licensing system,the issue of whether multiple rounds of review is necessary.And it puts forward the "star process","choose the acceleration procedure" and improve the hearing system recommendations.The fourth chapter discusses the problem of the ambiguity of the review criteria and the excessive investment of the parties and the proportion of the main innovations,and gives clear Formulate the obligations of the standard body,the reasonable construction standards and the specific degree,the improvement of the supervision system and the recommendations of the after-the-fact relief system,with a view to improving the relevant system and standards and providing a reference for the legislative practice of the subsequent relevant rules.
