The Research On The Quality Safety And Legal Protection Of Agricultural Products

During recent years, with the improvement of people's living level and unification of the international trade, the quality safety problems of the agricultural products are becoming one of focuses of people's attention from all walks of life and various countries. They have great effects on both the consumers' health and national export incomes. This thesis systematically analyzes the current situation and existing problems of the agricultural products. Firstly, this paper analyzes the current situation and existing problems of agricultural products links from producing to the consuming. In addition, this paper analyzes advanced foreign management models and their legal and institutional system. The author argues that both our country's quality safety system of agricultural products and legal and institutional system is far from being perfect, for instance, the management system is not completed, the principal part of law executor is ambiguous, the level of technological service is not satisfactory; further more, the system of legal institution hasn't been formed, and the level of law is still low. At the same time, the author furthers to argue that the foreign correspondent system is worth referring such as their reasonable division of labor, coordinated and complete management, their legal and institutional system. Which are various, large—ranged, systematic, scientific, easily operating and highly effective.On the basis of the above analysis, the writer made the following suggestions: reform the supervising organization, make clear the law executor subject, re—organize checking centers on food safety, quicken the steps of legislation, complete the standard evaluation and technological service system. The writer still holds that the safety legal system of agricultural products in the future should be a poly—leveled and synthesized one, which involves constitution, administrative law and regulations from central government to local governments, and the process of legislation should sufficiently reflects farmers' benefits.
