In the late 1990's, under the background of our country's economic system restructuring, China's urban land banking system arose from the reformation of land use and the development of land market, it is an important innovation of China's urban land management institution. The construction and implementation of this system has brought much social and economic benefit. It is vital for standardizing and cultivating the urban land market,increasing the revenue of city government, promoting the rational implementation of urban planning and so on. However, lack of further theoretical research, guidance of method and the support of matching measures, a lot of problems of the urban land banking system in relation to law, procedure and capital have been exposed in practice. First of all, the legal system of the urban land banking system is unsound. It practically represents that the law of this system is incomplete, the legal orientation of the urban land banking agency is ambiguous, the exploitation and the auction of the reserved land run short of the gist in law, in addition, the price of the land is not supervised effectively. Secondly, the current means of the supply of urban land has a serious shortcoming, it has brought out a lot of negative domino effects, such as the price of land rising continually, the image of the government is damaged, the life cost of people has increased, and the social welfare is affected. Thirdly, the current means of financing on the urban land banking is one fold and the loan has all kinds of risks. These problems have being largely restricting the implementation of the urban land banking system, and the social economic aim of this system can not be achieved. China's urban land banking system is entering into a pivotal development period; the city governments must solve these problems in the practice of this system by policy and regulations, so that the urban land banking can develop very fast and the aim of the urban land banking system can be realized, so that the function of this system can be deepened. What is most important is to improve the legal system in order to perfect the urban land banking system, and the main measures include quickening the building of law about this system, changing the investiture means of the urban land banking agency, improving the law in procedural aspects, establishing early buy system and so on. Otherwise, the shortcoming of the current means of the urban land's supply must be eliminated as soon as possible; a new model of item to invite public bidding is innovated in this article to replace the old one. At the same time, the city governments must ameliorate the capital circulation of the urban land banking system by efficiently tracking the financing, improving the management of using capital and the risk administration of loans.
