A Study Of Means To Improve Rural Land Circulation Trust In China

The key to solve the "three rural problems" lies in the innovation of rural land system. The rural land circulation is a major reform of China's land system. It was decided at the 3rd Plenum of the 18 th CPC Central Committee that we should encourage the circulation of management rights and develop the diversification of the contracted management of rural land circulation. Because of the main land circulation modes in rural areas, there are many defects, which not only lead to the small scale of land transfer, low efficiency, but also the interests of farmers cannot be guaranteed, and it will cause frequent disputes. The land circulation policy needs transformation desperately. In the end of 2013, Suzhou, Anhui province and Wuxi, Jiangsu province started pilot works of the land circulation each with CITIC Trust and Beijing Trust, which was the first truly land circulation trust in our country. Studying the problems and obstacles in actual operation of land circulation trust and providing options and strategy to the governments is quite meaningful.This paper studies the current situation of land transfer trust development in our country by literature research, deductive induction, case analysis and other methods. It points out that the problems existing in the present our country land trust mechanisms,and proposed the corresponding countermeasure. China's land transfer trust scale is expanding. The land transfer trust operation mode is upgrading. The land is gradually transferring to the high value-added modern. The land circulation trust in China has many problems: the land ownership system is not perfect; the higher risk of trust land transfer revenue and land trust may bring the problem of food security, the lack of benefit security of the owners and the later financing difficulties. It is pointed out in this paper that we should improve the legal system which is related to the land circulation trust, the financial services and the resources platform and ensure the rights of land users andimprove the follow-up financing mechanism.This paper not only refers to a large number of relevant theory, it also combines with the operation situation of pilot works of Suzhou and Wuxi, and makes a detailed analysis of the land circulation trust status, mode of operation, and the distribution of interests; it points out the problems, and puts forward the countermeasures. This study not only stay on the theoretical level, it also make the research and analysis on the basis of the practical case to achieve the combination of theory and practice and test truth through practice,which is a part of the relatively weak by earlier related scholars.
