Research On Legal Issues Of Ecological Compensation In China

Ecological compensation is a kind of solution, which some countries and regions try to deal with resource depletion and ecological destruction in the development of economic and society since the1950s. As an important means of ecological maintenance and construction, ecological compensation plays an active and important role in balancing and coordinating the tight relationship between the developments social and economical and ecological protection Scholars in different fields studied in ecological compensation from different angles, which had become a hot issue in ecology, environmental economics, environmental management and sustainable development fields.Environmental problems are very serious now in China, so people pay more attention on ecological compensate as a means to ecological protection and ecological construction But China has not yet formulated the basic ecological compensation law that scattered in a large number of environmental and resource protection one-line legal documents, especially in the local legislative documents. The hysteresis phenomenon of the ecological compensation legal system has the negative effects on ecological compensation practices in China. Based on this, I intend to depart from the perspective of law and study in the fields related to the legal system of China’s ecological compensation. I hope it can help.Structurally, this thesis consists of an introduction and a body part. The introduction part introduces the significance of this research, methods of research and making a comment on literature data. The main part is divided into four chapters. The first chapter, the second chapter is a fundamental part of this article, the third Chapter and the fourth Chapter is the focus of the discussion section of this article. The first chapter is the definition of ecological compensation By analyzing and sorting out the results of academic research and the current concept of ecological compensation, I define the concepts of ecological compensation and classify ecological compensation and outline the principles of ecological compensation.The second chapter is an overview of the theory of ecological compensation, which focuses on legitimacy of ecological compensation from three aspects. The three aspects are principle from the outside, environmental resource value theory and the theory of sustainable development. The third chapter is to discuss compensation standards and modalities for ecological compensation.And I mainly analyze the current situation of ecological compensation legislation standards and problems of our country then make some advices to make it better. I will discuss the problem of ecological compensation procedure in the fourth chapter which contains the object, how to start the procedures the consultation procedures, decision-making process.
