Studies On The Problems Of The Transformation Of Ip Right Of The Defense Science And Technology In China

At present, the conversion of the science and technology industry of national defense from military to civil use is one of the most important hotspot, which has important practical and far-reaching historical significance for the politics, economy and society of a nation. In history, from the World War II to the end of the Cold War, several major military powers have practiced the conversion at different levels or different stages. The essence of conversion means transfer and relocates, including land and natural resources, labor force, science and technology, information and other factors of production, making allocation more rational and effective. In nowadays, the peaceful uses of advanced military technology, turning to the development and civil use, changing advanced military technology into living productivity will release tremendous energy, which is a strong impetus to the development of politics, economy and society.To us, the conversion from military to civil use is a sharp shunt to national defense stratagem, it will not only profoundly affect national politics and diplomatic stratagem, but also the development of national economy and society. In order to accelerate the conversion, the occlusive system of national defense industry should be replaced, a new system, just as the civil-military integration should be established.The transformation of the national defense science and technology from military to civil use is a tremendous and complicated project. It is necessary to go through a major turning point from ideas and concepts, operating system, product development, the transformation to market development, and technical innovation and mechanism innovation and so on. There is need to lay out the system of construction and study carefully. In view of this, the author studies the actuality of domestic and international intellectual property laws, based on the ownership of the intellectual property of national defense, the results of national defense science and technology for civilian-based incentives, civil defense technology platform for the construction and operation of IP management and protection area will be reviewed. The author puts forward proposal of arrangement and amendments based on the original policies and regulations and attempt to make it regular, complete, coordinated and reasonable, to facilitate the conversion. The author also puts forward measures and suggestions of IPR protection appropriate for civilian defense science and technology achievements.
