Study On Chambers Of Commerce Governance System Under The Perspective Of Economic Law

The construction of chamber of commerce governance system is directly related to the operation and the development of chamber of commerce. However, the traditional approach, that constructs chamber of commerce governance system from the perspective of private law or from that of public law, has not fully reflected the inherent characteristics of chamber of commerce about public-private integration and market-government linking, and led to the absence or the offside of chamber of commerce governance system in practice. Therefore, building the chamber of commerce governance system, we must put aside the traditional perspective on private or public in the past, but from a"third jurisdiction"perspective of public-private integration - the vision of economic law. That we study and construct chambers of commerce governance system from the perspective of economic law is to achieve the perfect unity of internal governance and external supervision of this system. That is to say, chamber of commerce should be not only protected to have the autonomy and self-government in internal governance, but imposed the necessary external supervision on timely. Only in this way can we truly build the Chamber of Commerce governance system, which meets the practical needs of Chamber of Commerce development, and then ensure Chamber of Commerce to fully play the role of integrating private -public welfare and connecting market- government.This paper includes three parts: introduction, body and conclusion. The body is divided into five parts as follows.The first part is the definition and the legal features of Chamber of Commerce, which focuses on the connotation and denotation of the Chamber of Commerce, and gives a summary of the character of Chamber of Commerce.The second part is the general inspection of Chamber of Commerce governance system, systematically inspecting for Chinese and foreign chambers of commerce governance system, and focusing on the status and the problems of the contemporary Chinese Chamber of Commerce governance system.The third part is inspection of Chamber of Commerce and its governance system from the economic law's perspective, which focuses on the close ties between Chamber of Commerce and its governance system and economic law, and seeks more theoretical basis for inspecting Chamber of Commerce from the economic law's perspective.The fourth part is the theoretical basis and significance about building Chamber of Commerce governance system from the economic law's perspective, focusing on the theoretical basis that is related to building chamber of commerce governance system, and the theoretical and practical significance on constructing chamber of commerce governance system from the perspective of economic law.The fifth part is the basic ideas about building chamber of commerce governance system from the perspective of economic law, and it is put forward that building Chamber of Commerce governance system, we should not only protect the internal governance autonomy and self-government of Chamber of commerce, but also pay attention to imposing appropriate external supervision, and correctly handle the conflict and integration of Chamber of Commerce autonomy right and government regulatory power.
