| Along with our country's urbanization accelerated, it is inevitable that massive farmland was expropriated to satisfy the need of the economy development. However, in this farmland expropriation process, the rights and interests of farmers were invaded, such as the peasant's economic rights and interests gradation to lose, the political rights and interests were deprived and social rights and interests were vanished, so the problems of the farmers involved in land requisition attract everybody's eyes. In our country, land expropriation is one kind of government behavior, which plays an important role to guarantee the rights and interests of farmers.This paper took the public choice theory and the policy conduct theory as the foundation to analyze, and mainly elaborate the influence of the government behavior to farmers. In this paper, we pointed out that the farmers involved in land requisition were resulted by government's compulsory factor, and farmland expropriation was government's compulsory behavior. The enormous income was the power of land expropriation in present situation. The profit not only manifests in government's economical development, but the official's politic promotion. It has its system origin for government as the policy maker and the "the public interest" speaker. Although the government behavior goal is "the public interest", because of the system's deficit, the government's "economic man" status and some objective factors involved in the policy execution, not only neglects farmer's rights and interests in policy, moreover harms farmers in the execution.This article thought that the complex and changeable government behavior has enormous influence to the farmer's rights and interests, and we proposed the policy suggested: The government should return to his own role; completed the procedure; and established government lead's safeguard system for farmers, solved the problem from the government behavior aspect. |
