A Research On Urban Housing Guarantee System Of China

Nearly 30 years of reform and opening up, China has been the rapid development of productive forces, the GNP will reach an unprecedented level, comprehensive national strength and international influence will continue to increase, the acceleration of the process of industrialization and urbanization makes limited resources becoming increasingly scarce, people can enjoy the convenience brought about by modernization, also had to endure the pressure of growing tensions in the early 21st century, China urban housing issue has become a leading source of stress of people's lives, it seems overnight, people have to work hard to have a shelter, holding a set of public house become the greatest comfort to millions of people.In view of the current gaps in the urban housing guarantee research, I came to the concept of the right to housing guarantee by comparing the differences and connections between the concept of the urban housing guarantee and the social security concept,namely:the right established by the state through the legislative process, in the case of old age, disease, unemployment, poverty, demolition of the living conditions, or other reasons below the state's legal minimum living standards for specific groups, through the exercise of the functions of housing guarantee to enable them to exercise a minimum of living conditions.Then,I analysis the legal characters,attributes,constituents and legal liabilities and violations of the right to housing guarantee in depth from the perspective of constitutional law and jurisprudence, focused on analysis of the ownership of housing guarantee rights and obligations,features of the law,legal liabilities. In explaining the obligations of the right to housing guarantee,I regarded the state as the highest obligations holder to ensure the realization of housing guarantee right. and I linked to the obligations of the state of realization which belongs to the legal features of the right to housing guarantee and came to the conclusion that ensuring the realization of the right to housing is not an obligation to refuse .Then I rose the protection of the right to housing guarantee for urban residents to the height of human rights .Analysis of modern society citizens housing is a basic right to protection of human and constitutional rights, naturally the Constitution and the law should be specific and realistic as a right of citizenship. Preparing for the urgent need for legislation to improve housing guarantee system in last part of the article .The explanation of the theory part of the housing guanrantee is the core content of this article .The combination of the theory and practice is another key of the article. In the following chapters the author describled development of urban housing guarantee system briefly from the establishment of the socialist system in our country to now, and then focused on analysis of the composition of China's urban housing guarantee system,and the current operation of the urban housing guarantee system to set the tone for the improvement our urban housing guarantee system."Make the past serve the present, make foreign things serve China" is one of the successful experiences of China's modernization construction. Therefore borrowing from the successful experiences of foreign developed countries of the housing guarantee system is not only necessary but imperative. Not only save valuable time in the modernization construction. But also makes China's housing guarantee system more effective to urban vulnerable groups.The author chose to solve the housing problem from a relatively successful learning from the United States and Singapore. Analysis of the housing guarantee system and learn, our urban housing guarantee system can be used as nutrients, with a view to improving China's urban housing guarantee system.Finally the author Analyzed the failings of China's urban housing guarantee system and the perfection of the pertinent views proposal by combining urban housing guarantee right of the theoretical analysis and China's current urban housing guarantee system and the successful functioning of the United States and Singapore as well as the experience of the housing guarantee system.
