Since 20th century 90 years,many of our scholars had been studying and exploring the problems of land requisition system in China from different angles, tried to establish a new system of land requisition, resolved the various problems in the process of land requisition。The compensation for the requisition of land which is the core or key of land requisition, especially after the economic system had fundamentally changed,,State requisition land can no longer in accordance with the period of the planned economy completely use administrative means free or lower compensation to get land ownership, then sold the land-use rights to other units according to the market in the allocation on high-priced, from which to grab large amounts of land income,,or on the process of state's key infrastructure construction, only considered to alleviate the burden of the government, but shifted the burden to the farmers whose land had been requisitioned。Therefore, at this stage study the land requisition system had become the current hot problem。This paper mainly aimed at the appearance problem about the current process of land requisition, applied the theory of property rights,rent theory and other theories, systematic analyzed the existing flaws of land requisition system, and combined the experiences of domestic and international, based the reality of the country concerned, from the scope of land requisition,clarifying property rights of rural property,compensation standards and the construction of rural land on the transform of right to use it and so on ,researched the methods how to solve the problems of rural land requisition system。The system of abroad numerous and complicated, it impossible to compare all the systems, in this paper, according to the United States, Germany, Japan, Canada and China's Hong Kong the land requisition systems for the typical highlights, and referred to other countries or regions of the system,compared and analyzed our country's land requisition system, find the suitable land requisition system for China's national conditions。This paper is divided into four parts; the first part includes the first chapter。Tqhis part focuses on land requisition basic theories, is the basis of the transcript; the second part includes the second chapter, through the comparative analysis of abroad land requisition, discussed the domestic and foreign requisition of land on the specific performance and the reasons about the problems of land requisition, in what respects to tackle the issue of land expropriation laid the groundwork; the third part includes the third chapter, this part systematic introduced our country's land requisition system and the cause of formation, to lay the theoretical foundation for the next chapter; the forth part includes the forth chapter, the countermeasures about solving the problem of land requisition, it is the core of this paper。On the basis of the front several parts, discussed on how to solve the problem of land requisition system。...
