Administrative Law Enforcement Reform Of Urban Management With A Background Of Building The Service-oriented Government

This paper probes into the issues in the process of city administrative enforcement from the perspective of service-oriented government. There have been many researches on city administrative enforcement; however there are not many studies under the circumstances of service-oriented government construction. The paper tries to analyze the problems of city administrative enforcement under the framework of service-oriented government analysis.City administrative enforcement is a managing means of a city government sector to maintain the citizen's normal life, whose purpose is to protect the order of city life, serve better to people's production and life. However, the city administrative enforcement in actual life is far away from this standard. For a long time, the phenomenon of violent enforcement and authority-exceeding enforcement continuously appears in city administrative enforcement, which is not only harmful to the favorable image of government in the public, but also baffling to city administrative enforcement's effective carrying and an obstacle in constructing the harmonious socialist society. This paper puts forward specific demands of regulating city administrative enforcement from the understanding of city administrative enforcement's current status and years of researches on constructing service-oriented government. This paper can be divided into four parts:Part I Service-oriented Government is the value orientation of Chinese government revolutionIn this part, I elaborate on the meaning of service-oriented government and its characteristics. I hold that service-oriented government is the government which under the theories and framework of constitution and democracy, insist on rooting in people, taking serving as its aim, performs public interests according to law, pursuits public interests and assumes public duties. It carries the basic characteristics of"root in people, service, law-obeying, low-price and self-revolutionist". Then I discuss the importance of constructing service-oriented government on this basis. In my view, construction of service-oriented government is the certain claim of construction of harmonious socialist society; it is the key point in adjusting the relationship among enterprise, society, market and government; and it is the positive response of our government towards the economic globalization and government reformation. From the above discussion, I demonstrate why constructing service-oriented government is the value orientation of Chinese government reformation, and take this as a theoretic basis for the argumentation in the next place.Part Two The Demands for City Administrative Enforcement of Constructing Service-oriented GovernmentSince service-oriented government is the value orientation of china reformation, city administrative enforcement, as a substantial part of government administrative function, has to take the basic conception of service-oriented government as a guide to reform effectively. Service-oriented government demands that city administrative enforcement should insist on rooting in people. Rooting in people is the fundamental representation of service-oriented government. It asks for humanism in city administrative enforcement, and everything is done from the people's interests. Service-oriented government claims that city administrative enforcement should take system regulating as a key point. The effective regulation leads to the true legalization of city administrative enforcement reformation. It deserves that city administrative reformation should take"administration adhered to law"as central point. City administrative enforcement plays an important role in Chinese city management. The enforcement should strictly follow the legal regulations, abide by the procedure arrangement, respect the administrative subjects, do the administrative enforcement according to law in earnest, execute the law legally, make the people be convinced, respect law-executing authority and elevate self consciousness of law. Then the law enforcement relationship would be harmonious. Service-oriented government demands that reformation of city administrative enforcement should take cutting down administrative costs as its strategy. Through cutting down the administrative costs, it can promote the performance of city administrative enforcement. Service-oriented government asks the reformation of city administrative enforcement follow the mass line. City administrative enforcement and the people's interests are closely related, so the city administrative enforcement should shift conceptions quickly; insist on following the mass line and get rid of the working conception of"working independently". It should lean on the people closely, and call on the whole society to be involved inn the administrative enforcement. Service-oriented government asks the reformation of city administrative enforcement heading on digitalization."Digital City Administrative Enforcement"is a direction for city management reformation and management modernization. It helps to accomplish the fleet inter-movement between citizen and government, and effectively resolve the problems of information dissymmetry, bad performance in the work of administrative enforcement.Part III The main Problems existing in city administrative enforcementService-oriented government put forward higher demands for city administrative enforcement, while actual status is far away from the ideal one. It embodies in: infirmity and no-mating of city administrative system; the universal existence of inhumanly violent execution; prominence of violating the executing procedure. The power and duty in city administrative enforcement are vague, and there exists universal conflicts between departments and prevarication; improperness in allocation of managing resources; lack of funds; low involvement of people, vagueness in system of mass supervision; fall-behind of executing means; and bad executing performance. The existing problems wait to be corrected and modified.Part IV The City Administrative Enforcement Reformation under the Circumstances of constructing Service-oriented GovernmentOn the basis of analyzing series of problems in city administrative enforcement, answering to the demands of service-oriented government, I hold that reformation of city administrative enforcement should begin with following aspects. Firstly, city administrative officers should build up the consciousness of serving the people. Secondly, the laws and regulations concerning administration should be strengthened and perfected. Thirdly, the supervision upon the administrative enforcement officers should be enhanced. Fourthly, city administrative enforcement should always involve mass supervision and mass participation. Fifthly, the managing mode of city administrative enforcement should be shifted into network mode. The network managing system should cover the administrative executing region; the city managing supervisor should be taken as the supervision person responsible. A supervision system should be set up the whole time, and the all-direction's management should be established through network examination.
