The Guard And Management Of Commerce Bribe In Government Procurement Field

Government procurement refers to purchasing goods, construction and service, which are included in the legal catalogue for centralized purchasing and are beyond the standard for purchase limit, by the state agencies in all phrases, institutions and organizations with financial funds. The government purchase system can strengthen the management of financial expedition, standardize the behavior of purchase under the circumstance of market economy and it is also an important component of constructing our socialism market economic system.The dissertation reviews the situation of our government procurement system since 1995 generally, and then researches into commerce bribe in government procurement field systematically and thoroughly. In recent years, our party and government has paid close attention to this issue. In the research project,this dissertation firstly states the importance and necessity of the specialized administration on commerce bribe in government procurement field from the view of purchase practice. At the first place, the dissertation analyses the status and rights of interested parties, such as purchasers, purchase agencies, experts of judging panel and suppliers and so on.During the process of market exchanging, it discloses and discusses motivations and manifestation in commerce bribe, and studies deeply many fields in commerce bribe happened in the process of procurement such as the manifestation of bribe, main characteristics, harmfulness and the reasons of chains which are liable to come up. At the same time, the dissertation investigates and studies the difficulties existed in the management of government procurement in China. Based on this analysis, the dissertation also collects, sorts out and compares the information about how others are on guard and manage commerce bribe in western modernized countries, and analyzes the features of special management on commerce bribe in modernized countries. In the end, according to the practice of our government procurement, the dissertation insists on that it should absorb and draw the experience of modernized countries' good systems and mechanism. From the view of policies and system, the dissertation puts forward a series of strategies to settle the problem of commerce bribe as followed:Pushing forward the system construction, building scientific and reasonable operation system, strengthening the supervision and management, forming joint effort to manage commerce bribe, deepening reform, constructing creative methods and ways, reducing administrative interference, highlighting the basic affect of market system in resources arrangement, heightening the effectiveness of punishment , enhancing the cost of commerce bribe, strengthening the construction and management of experts' information data base, regulating the choice and employment of experts, perfecting the related works and improving the strategies to guard and manage the commerce bribe in government procurement's market.
