Research On Normative Government Procurement Behavior Under The Legal Environment

The government procurement has a history of more than 200 years. It is a fundamental means to use the national financial fund. The purpose of government procurement is to realize the national microeconomic control and maintain the public safety and legitimate rights. In the development of government procurement, countries all over the world had established the integral legal system.China started government procurement later than developed country. We implemented the "Government Procurement Law" in 2003.The original aim of the government procurement is to regulate government procurement behavior. Then the government procurement can be applied in a fair, open and transparent environment. Thus we can realize the so-called "Procurement under the Sun". However, we need to improve the government procurement system and implementation details to realize the normative behavior of government procurement. And we also need to optimize procurement processes, while we can improve the overall quality of procurement staff, and establish long-term monitoring mechanisms.The paper bases on the current research on government procurement system. It compares the difference of the law system between China and developed countries. On the base of the discussion on concept, characteristics and the principles of government procurement, the paper analyses the procurement mode of different countries. Thus, it focuses on five aspects of the main problems of government procurement. The five aspects are procurement law system, procurement stakeholders, procurement procedures, supervision and restraint mode, and electronic government procurement."Implementation Regulations on Government Procurement" applies in 2015. It makes the "Government Procurement Law" more operational.Thus it can give some legal solutions to the problems provided in this paper. It provides an effective legal protection to build integrated management mechanisms of government procurement.After the explanation of "Implementation Regulations", the paper uses the interdisciplinary research to apply knowledge management and information technology in government procurement field. It uses the functions in knowledge management to induce, consolidate, extract, feedback explicit knowledge and tacit knowledge. We can use the electronic government procurement to practise the detailed of laws and regulations and advanced knowledge management concepts. We also promote the integration of existing government resources to utilize the modern information technology and network technology to realize an integrated electronic government procurement system on the Cloud platform.
