Study On The Patent Management For Government

In recent years, Jilin Provincial Government's patent management work has benefited in development of various missions in some old industrial bases across Jilin Province in order to strengthen creation, operation, protection and management of the Proprietary Intellectual Property within enterprises, science and research institutions and universities. The development in patent management presents a good situation in Jilin, but still lays some outstanding problems. The dissertation is based on a complete understanding in the situation of patent management in Jilin and to put forward a relative solution and strategy against those outstanding problems. The dissertation consists of three chapters:Chapter one gave the definition of patent and government patent management, and made a good foundation for study of government patent management, in the meantime, pointed out the position and function of government patent management in socialistic market economy; Also, Chapter Two explained reasonable assignment of technology resources, promotion of technology innovation, promotion of combination of science & technology and economy, guarantee of competitive advantage of market, norm of market conduct, support of economical order, promotion of international trade.Chapter two analyzed comparatively the situation of development of patent over last five years in Jilin, objectively evaluated the level of patent job, summarized propaganda training, patent job of enterprises, conversion of patent achievement and current circumstance of patent protection according to Jilin's concrete situation as an individual case. The existing outstanding problems in patent management of Jilin Provincial Government are as follows: lack of patent consciousness within business enterprises, universities and colleges, lag of system construction of Jilin Provincial Government's intellectual property, poor rationalization of patent structure, the ability of proprietary innovation, big difference in patent management structure between cities in Jilin, imbalance in distribution of patent work, incompletion of patent agencies, shortage of talents in patent work, continuous strengthen in the patent enforces law.Chapter three completed strategy analysis in government patent management. (1) The government needs to develop and propagandize patent training in many aspects in order to strengthen patent consciousness of the entire society. (2) The government could improve patent work within enterprises and companies through lead of policy. (3) All governments ought to speed the construction of structure of patent work and form network of patent management work in terms of "being a line in vertical direction and reaching edge in horizontal direction" and establish moderate mechanism of intellectual property within government systems and enhance the function of the intellectual property bureau. (4) To strengthen construction and supervision towards patent agencies. (5) To enforce the patent law and maintain a good order of market economy.
