This thesis is to study the arable land protection institutions which can be backward to beginning of reform and opening policy. It has been for about thirty years and, it had made great contributions for ensuring food security in China, but with rapid development of economic, the arable land protection institutions have shown some problems when carrying on. It is so urgent to research how to innovate and perfect the arable land protection institutions to get a long goal for protecting arable land under current grim situation. As with progress of new institutional economics'research, the new institutional economics theory is used to study arable land protection institutions with unparalleled advantages in technology, compared with traditional research methods.After reading a lot of relevant literature at home and abroad, theory of the New Institutional Economics is used to analyze arable land protection institutions. Literature review is from system's make-up perspective, that is, informal system, formal system and implementation mechanisms. It deals with formation and evolution of arable land protection institutions from view of path dependence. On this basis, the path dependency theory, transaction costs theory and property rights theory of the new institutional economics are used to analyze the arable land protection institutions'contents from various aspects, so as to provide policy recommendations for innovating and perfecting the arable land protection institutions and, establish related policies of the arable land protection institutions.The major conclusion is: First, land expropriation process exist vested interests. Local government expropriated high-quality arable land near town for economic construction to get the goal of GDP's increase which didn't carry out the arable land protection institutions in deed. Second, one-sided arable land protection evaluation system makes a pattern of game between the central government and local government and, the local government carries out economic construction at the cost of arable land and, the central government penalizes principal of illegal land use less in accordance with law, which is not enough to overawe potential illegal land use and it's principal. Third, establish smooth, effective and timely communication channels between the central government and the landless peasants, reduce the cost of safeguarding peasants'rights and interests in accordance with law, protect the legitimate rights and interests of peasants timely and efficiently and, protect arable land in deed. Fourth, Formation of Arable Land Protection Institutions exist path dependence. Allowing public participate in the arable land institutions and policy formulation and implementation process can reduce it's administrative costs and, is conducive to the implementation of arable land protection institutions.
