The Research On The Intellectual Property Rights Protection For Tibet Medicine In China

At previous century, the Chinese traditional medicine was subjected to western medicine, but Tibet medicine was known by more and more people. In the 21st century, along with the world regressing to nature, the green consumes is rising, and the natural medicine promotes continuously to the consumer, people start to cure the problems induced by the chemical medicines such as harmfulness, side effect, drug-fast and the medicine source diseases etc. by natural medicine or non-medicine. Tibet medicine, purely natural, free from pollution, highly purity, greatly efficient but become the green drug as the first choosing for most people. However, at present a lot of nations spot to the huge business opportunities contained in Tibet medicine. Numerous foreign medical organizations already intensify the research in Tibet medicine, which will give a great blow to the development and production of Tibet medicine in China. Therefore, it's of much urgency to adopt a valid intelligent property right protection for Tibet medicine, the fruit of national minority of Tibet people's intelligence labor.Based on the exposition of the concept, category and relationship between the intellectual property rights, this paper discusses the inevitable relationship between Tibet medicine and the intellectual property rights, the Tibet medicines that can be included in the category of the intellectual property rights protection, and the model of the intellectual property rights protection system of Tibet medicine. This article also analyzes protection systems of traditional medicine in some foreign countries by using comparison analysis methods, finds out some successful and advanced experiences and seeks the intellectual property rights protection system of Tibet medicine in China.This article consists of three parts: preface, main text body and epilogue. There are four chapters in the main text body. They are as follows: Chapter one mainly introduces the definition, characteristics and recent development of Tibet medicine, and analyzes the feasibility and necessity and of adopting intellectual property rights protection for Tibet medicine.Chapter two analyzes the objects that can be integrated in the category of intellectual property rights protection for Tibet medicine, discussions are made in patent, trademark and copyright.Chapter three mainly presents the protection systems of Thailand, India, Laos, Philippines, obtaining some enlightenment to the intellectual property rights protection for Tibet medicine.Chapter four seeks the intellectual property rights protection system of Tibetmedicine in China, obtaining the main two ways------business secret andgeography marking protection as the model for the intellectual property rights protection system of Tibet medicine.
