At present, China is being in the key period of social transformation, labor management relation imbalance exposed in the traditional society and the pressure of reconstruction appears suddenly. Since reform and opening up, the non-public-owned enterprises in China have sprung up everywhere, they have played an important positive role in absorbing labor force and promoting economic and social development, but survey data also showed that labor management relation contradiction and conflict in the non-public -owed enterprises are quite serious, it already became prominent social problem which had affected social stable harmony and economical health sustained development, so it causes the Government and the community's concern. Under this background, we do some comprehensive research on the imbalance problems, the reasons, the influence and the countermeasures of the labor management relation, it has an important practical significance in solving labor management relation contradiction and in realizing labor management relation harmony and in constructing social harmony.This thesis belongs to case study about the number of non-public-owned enterprises, it mainly uses interview method and literature method to collect materials, and then it adopts qualitative method in analyzing acquired materials, at the same time it has carried on a multi-directional explanation based on Marx's theory of class analysis, social conflict theory, Weber's theory of industrial capitalism and so on.This thesis is divided into six following six major parts altogether:"Introduction", is about what problems the thesis is researched, why this theme is researched, what the meaning of key concepts is in the thesis, and what the research methods is used in the thesis.Chapter 1 "Literature summary and historical review" has mainly organized two big contents, the first is comprehensive summary and evaluation about labor management relation literature materials at home and abroad, and the second is brief review and summary about labor management relation at home and abroad historical changes, it has provided necessary historical background reference and theoretical and methodological support for the development of this study. ChapterⅡis on the cases which has been examined in detail, first of all, it has introduced the present situation of labor management relation in the period of social transformation, in accordance with the interviewee's conversation, I found several questions: low labor contracts, long working hours and labor-intensive, poor working conditions and low safety coefficient, serious problem of wage arrears, and several other serious problems, and then it pointed out these problems brought a negative impact to the enterprise and the society .ChapterⅢ, it carried on detailed analysis to the reason of labor management relation imbalance, labor supply and demand imbalances, the lack of government supervision, trade unions construction lagging behind, imperfect laws and regulations and poor law enforcement efforts, both employers and employees immature, and weakening social and moral education, these factors above will directly or indirectly caused imbalance in labor management relation.ChapterⅣ, it pointed out some possible beneficial enlightenment and reference significance to our country's labor management relation adjustment mainly through summarizing the United States, Germany and Japan these country's labor management relation adjustment Countermeasure, that is, enhancing labor management relation legislation, paying attention to the independence of trade unions, developing tripartite coordination mechanism.ChapterⅤput forward a number of macro and micro countermeasures according to present situation ,problem and reason about labor management relation imbalance, including improving the legal system, and strengthening government supervision and building a tripartite coordination mechanism, giving full play to the role of trade unions, improving the quality of employers and employees and raising the ethical culture, in order to constructing the democracy, legal and harmonious new labor management relation, so as to promote and achieve social harmony and sustainable development.
